1. Agreement to Terms

By accessing or using Servus Bonus, a volunteer management platform ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of the Terms, you do not have permission to access the Service.

1.1 Eligibility

The Service is available only to users located in the United States. You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

2. Description of Service

The Service is a volunteer management platform designed to help organizations coordinate events, schedule tasks, and manage volunteer participation. The Service is not affiliated with any religious organization and is designed for use by any type of organization that manages volunteers, including schools, churches, non-profits, and neighborhoods.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.1 Account Types

The Service offers different account types:

  • Owner/Administrator: Full access to organize events, manage volunteers, create tasks, configure system settings, and manage subscription billing
  • Volunteer: Limited access to view schedules, request substitutions, and manage personal availability

3.2 Account Security

You are responsible for safeguarding the password for your account and for any activities or actions under your account. The Service cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.

3.3 Communications and Notifications

By creating an account, you acknowledge that the Service will send you transactional communications that are necessary to provide the Service, including schedule confirmations, changes, reminders, substitution requests, and important service alerts ("Transactional Emails"). You cannot opt out of Transactional Emails while using the Service.

3.4 No Marketing Emails

The Service does not send marketing or promotional emails. You will never receive advertisements from the Service.

3.5 Imported Contacts

If you add or import volunteers' contact information, each imported volunteer will be required to agree to these Terms and our Privacy Policy upon their first login, and must verify their email address before using the Service.

4. Subscription Plans

4.1 Plan Options

The Service offers subscription plans with different feature limits. Current plans and their limits include:

Feature limits are subject to change. Current limits are always displayed within the Service.

4.2 Payment and Billing

Paid subscriptions are billed monthly or yearly according to the terms specified at the time of purchase. You authorize the Service to charge your payment method for all fees incurred in connection with your account. Payments are processed through Stripe, a third-party payment processor.

4.3 Plan Changes and Proration

You may upgrade or downgrade your subscription at any time. When you change plans, charges are prorated based on the remaining time in your current billing period.

4.4 Subscription Modifications

The Service reserves the right to modify subscription plans and pricing. Any changes to subscription rates will be communicated at least 30 days in advance.

5. User Content

5.1 Your Content

You retain all rights to the data you input into the Service. By using the Service, you grant us a limited, non-exclusive license to use, process, and store this content solely for the purpose of providing and improving the Service.

5.2 Prohibited Content

You agree not to use the Service to upload, transmit, or otherwise distribute:

  • Content that violates the rights of others
  • Abusive, threatening, obscene, or defamatory content
  • Malicious code or content designed to disrupt or compromise the Service
  • Content for unlawful purposes or in support of illegal activities

6. Privacy and Data Protection

6.1 Data Collection

The Service collects and processes personal information as described in our Privacy Policy. This may include names, email addresses, phone numbers, and scheduling preferences of administrators and volunteers.

6.2 Data Processing

Personal data is processed for the purpose of facilitating volunteer management, scheduling, and communications. The Service processes data in accordance with applicable United States federal and state data protection laws.

6.3 Data Security

The Service implements reasonable security measures to protect your data, including encryption and secure storage practices. However, no internet transmission is completely secure, and we cannot guarantee absolute security.

We process your email address to send Transactional Emails related to your participation (e.g., assignments, changes, reminders). The Service does not send marketing emails.

6.4 Data Access and Control

Organization administrators have access to volunteer data within their organization. The Service will not share your personal information with third parties except as necessary to provide the Service or as required by law.

7. Intellectual Property

7.1 Service Content

The Service and its original content (excluding User Content), features, and functionality are owned by Servus Bonus and are protected by copyright, trademark, and other intellectual property laws of the United States.

7.2 Restrictions

You may not:

  • Modify, distribute, or create derivative works based on the Service
  • Attempt to decompile or reverse engineer any software contained in the Service
  • Remove any copyright or other proprietary notations from the materials
  • Use the Service to build a competing product or service

8. Termination

8.1 Termination by You

You may terminate your account at any time using the account deletion feature within the Service or by contacting us at support@servusbonus.com.

8.2 Termination by Us

The Service may terminate or suspend your account immediately, without prior notice or liability, for any reason including, without limitation, if you breach these Terms.

8.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. The Service may delete or preserve your data according to our data retention policies described in the Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Servus Bonus, its owners, operators, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

In no event shall the total liability of Servus Bonus exceed the amounts paid by you to the Service in the twelve (12) months preceding the event giving rise to the claim.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

11. Dispute Resolution

11.1 Informal Resolution

Before filing any formal legal action, you agree to first contact us at support@servusbonus.com and attempt to resolve the dispute informally for at least thirty (30) days.

11.2 Binding Arbitration

If we cannot resolve a dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in King County, Washington.

11.3 Class Action Waiver

You and Servus Bonus agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

11.4 Small Claims Exception

Notwithstanding the above, either party may bring an individual action in small claims court in King County, Washington.

12. Changes to Terms

The Service reserves the right to update or modify these Terms. For material changes, we will provide at least thirty (30) days' notice by posting the updated Terms on the Service or by sending you a Transactional Email. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. To the extent that litigation is permitted under these Terms, you consent to the exclusive jurisdiction of the state and federal courts located in King County, Washington.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Servus Bonus regarding the Service and supersede any prior agreements between us regarding the Service.

By using this Service, you acknowledge that you have read these Terms of Use, understand them, and agree to be bound by them.
